Terms and Conditions

These Terms and Conditions apply to the Hearth app for mobile devices, together with any related services and websites operated by Bob Dudziak (collectively, the "Application"). Bob Dudziak is referred to below as the "Service Provider."

By downloading or using the Application, you agree to these Terms and Conditions and to the Community Guidelines, which are part of these Terms. Please read them carefully before using the Application.

About Hearth

Hearth is a recipe app for collecting, cooking and sharing the food you love. You can save recipes from websites, photos of cookbook pages or your own kitchen, organize them into folders and tags, and cook from them with step-by-step guidance, timers and optional hands-free voice controls. Hearth can also estimate nutrition information, suggest recipes similar to a dish you photograph, and build shopping lists that you can share with others.

Hearth is also a community. You can follow other cooks, share recipes and folders, send messages, comment, and log the recipes you have made with ratings and notes. You choose what others can see, and you can also create a public link that lets anyone view a recipe, even without an account.

Who can use Hearth

You must be at least 13 years old to use the Application. By using it, you confirm that you meet this requirement and that you are legally permitted to use the Application where you live.

License to use the Application

Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on a mobile device for personal use. You may not reproduce, distribute, modify, create derivative works from, reverse engineer, decompile or disassemble the Application, except to the extent that applicable law expressly permits it.

Intellectual property

The Service Provider keeps all intellectual property rights in the Application, including its code, design, trademarks, service marks, trade names, logos and branding. Nothing in these Terms gives you any right to use them. You agree not to remove, alter or obscure any copyright, trademark or other proprietary notice in the Application. Any attempt to extract the source code of the Application, translate it into other languages or create derivative versions of it is not permitted.

Your account

You are responsible for the information you give when you sign up, for keeping your password secure, and for everything that happens under your account. You can delete your account at any time from within the Application.

Content you post and how you may use Hearth

You agree not to post, share or send content of any of the following kinds.

• Content that is illegal or violates someone else's copyright, trademark or other rights.
• Content that is abusive, threatening, harassing, defamatory or hateful.
• Content that discriminates against people or encourages violence or illegal activity.
• Spam, phishing or anything that contains malware.
• Content that violates the privacy of others, including sharing another person's personal information without their consent.
• Content that is misleading, false or deceptive.
• Explicit violence or sexual content.

You also agree to follow the Community Guidelines. Do not create additional accounts to get around a block or suspension, and do not pretend to be another person.

Content you submit may be visible to other users or to the public, depending on your settings and how you share it.

Reporting, blocking and moderation

You can report content and block other users directly in the Application. You can also report content or a violation by emailing the Service Provider at support@hearthbound.download. Please include enough information to identify the content and explain your concern.

The Service Provider may review reported content, ask for more information, remove or restrict content, hide it, warn a user, suspend an account or permanently remove an account. The Service Provider may also filter or moderate content that appears to violate these Terms, the Community Guidelines or the law. Moderation decisions are made at the Service Provider's discretion. The Service Provider may cooperate with law enforcement when illegal content is reported.

If you believe content in the Application infringes your copyright, email support@hearthbound.download with a description of your work, where the content appears in the Application, your contact details, and a statement that you believe in good faith that the use is not authorized.

The license you give us for your content

When you submit content to the Application, you keep ownership of it. You give the Service Provider a non-exclusive, worldwide, royalty-free license to use, store, reproduce, display and distribute your content, and to make changes needed to display it, in connection with running and improving the Application. This license does not allow the Service Provider to sell your content to third parties. The license ends when you delete the content or your account. The exception is edited copies that other users have made under their own accounts, and routine backups that are removed on a normal schedule.

You confirm that you own or have the right to share the content you post, and that it does not violate these Terms or the law. Recipes you copy from other sources may belong to someone else, so please credit and share responsibly.

Your content may include personal information. How personal information is handled is described in the Privacy Policy. Do not post other people's personal information without their consent.

Public links and visibility

You can create a public link to one of your recipes. Anyone who has the link can view that recipe without an account, and the link always shows the current version of the recipe. Turning off Viewable Profile in your settings disables all of your previously shared links. Anyone who has a link can forward it, so only share what you are comfortable with anyone seeing.

Recipes, nutrition information and AI features

Recipes, cooking times, ingredient substitutions, nutrition estimates and other information in the Application are provided for general reference only. They are not professional dietary, medical or food safety advice. Nutrition values are estimates calculated from ingredients and may be inaccurate. Recipes posted by other users are not reviewed or tested by the Service Provider.

You are responsible for checking ingredients for allergens and dietary needs, for cooking and storing food safely, and for deciding whether a recipe is right for you. Speak to a qualified professional if you have medical or dietary concerns.

Some features of the Application use artificial intelligence provided by third parties, for example to read recipe photos and to suggest what a dish might be. When you use these features, the photo or text you provide is sent to the third-party service for processing. AI results can be wrong or incomplete, so please review them before relying on them.

Your device, connection and charges

The Application stores and processes personal data that you provide in order to work. You are responsible for the security of your mobile device and your access to the Application. The Service Provider advises against jailbreaking or rooting your device, since this can expose it to malware and cause the Application to stop working correctly.

Some features need an internet connection. The Service Provider is not responsible if the Application does not work fully because you do not have access to Wi-Fi or have used up your data allowance. If you use the Application outside a Wi-Fi area, your mobile provider's terms still apply, and you may be charged for data or roaming. If you are not the bill payer for the device, the Service Provider assumes you have the payer's permission. It is also your responsibility to keep your device charged.

Nothing in these Terms limits any rights you have under consumer protection laws that cannot lawfully be excluded.

Updates, changes and charges

The Service Provider may update the Application, and you may need to download updates to keep using it. The Service Provider does not guarantee that the Application will always work with your version of the operating system, and may stop supporting older versions. The Service Provider may modify the Application, stop offering it, or begin charging for it or for some services at any time. Any charges will be clearly communicated to you before they apply.

Termination

The Service Provider may suspend or end your access to the Application if you break these Terms. Where the breach can reasonably be fixed and is not a violation of the acceptable use rules above, the Service Provider will notify you and allow 14 days to fix it before ending your access. The Service Provider may suspend or end your access immediately and without notice if you violate the law, infringe intellectual property rights, violate the acceptable use rules or the Community Guidelines, or engage in activity that could harm other users or the Service Provider.

You can stop using the Application at any time and delete your account. When access ends, your license to use the Application ends and you must delete all copies from your devices.

Limitation of liability

To the fullest extent permitted by law, the Service Provider is not liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, data loss or business interruption, even if the Service Provider was told such damages were possible.

To the fullest extent permitted by law, the total liability of the Service Provider for any claim will not exceed the amount you paid for the Application in the 12 months before the claim, or the minimum amount required by applicable law, whichever is greater. If the Application is free, the liability is limited to the minimum amount permitted by law.

The Service Provider accepts no liability for any loss you experience from relying on information provided by other users or by third parties through the Application, or for inaccuracies in that information.

Indemnification

To the fullest extent permitted by law, you agree to defend and hold harmless the Service Provider from claims, losses and expenses, including reasonable legal fees, that arise from your breach of these Terms or your intentional misuse of the Application, including content you submit in violation of these Terms. This does not apply to claims that arise from the Service Provider's own negligence, breach of these Terms or violation of the law. Where the law restricts this for consumers, it applies only as far as the law allows.

Governing law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law rules, except where mandatory consumer protection laws say otherwise. Any dispute arising from these Terms will be brought in the state or federal courts located in Georgia. Nothing in this section limits any right you have under mandatory law to bring a claim in another court.

Severability

If any part of these Terms is found to be invalid or unenforceable, that part will be changed only as much as needed to make it valid, and the rest of the Terms will remain in effect.

Entire agreement

These Terms, together with the Community Guidelines and the Privacy Policy, are the entire agreement between you and the Service Provider about your use of the Application and replace any earlier agreements.

Changes to these Terms

The Service Provider may update these Terms from time to time. Updated Terms will be posted on this page with a new effective date. Continuing to use the Application after a change means you accept the updated Terms. Earlier versions are available on request at support@hearthbound.download.
